Tackling Nuisance Conditions: Civica Law Helps City Successfully Abate a Downtown Dumping Lot

A vacant lot in the downtown of a city served by Civica Law became the focus of code enforcement due to its transformation into an encampment riddled with unlawful nuisance conditions. This site, full of accumulated junk, trash, debris, dead and overgrown vegetation, and improperly stored inoperable vehicles, including an RV, boat, and 5th wheel trailer, presented a complex legal and social issue.

The situation was exacerbated when the owner of the property rented it out to a junk hauler, who subsequently vacated, but left behind vehicles that attracted illegal camping, which turned the lot into a dumping ground. The owner remained unresponsive despite the City’s efforts, including prior notices, citations, and a formal request for consent to abate.

The Path to Abatement: Overcoming Legal and Social Hurdles

After months of extensive efforts by the city to gain compliance, including multiple inspections and a comprehensive noticing process, the city contacted Civica Law for legal assistance. The group assisted the city in navigating the administrative abatement process and ensuring the owner was provided due process while complying with other constitutional requirements, ultimately resulting in obtaining a civil abatement warrant authorizing the city to abate these nuisances.

Court Approval and Execution of the Abatement Warrant

The court recognized the gravity of the situation and granted the abatement warrant. Soon thereafter, the city executed the warrant, following additional notice. The operation was a significant undertaking, resulting in the removal of over 100 cubic yards of junk, trash, and debris, including a full-size boat and a 34-foot 5th-wheel trailer. Additionally, minor tree trimming was conducted to address the overgrown vegetation. As part of this process, the city provided those illegally camping on the property with social services and housing assistance.
