Two Duarte apartment complexes with over 350 violations achieved compliance with the assistance of a court-appointed receiver.
This property gained the attention of the City of Duarte’s enforcement department due to its numerous substandard conditions at two multi-unit apartments buildings at a single address. The City issued various notices of violation, conducted several inspections, issued red tags and orders to repair. The City ultimately issued a detailed Notice and Order to Repair, listing over 350 (354) violations of law. Each deadline expired without compliance.
Before
After extensive efforts to gain compliance without resorting to court action, the City filed for a Complaint for Nuisance Abatement and Receivership. Given the strength of its supporting evidence, the City was able to influence the property owners to agree to the appointment of a receiver immediately, with the condition of powers would be stayed while the property owners brought it into full compliance.
Ultimately the receiver started working on the property but due to unhappiness with the quality, speed and cost of repairs, a replacement receiver was approved by the Court. The new receiver took control of the property responsibly by retaining consultants and obtaining permits from the City.
After
The City and the new property owner entered into a compliance agreement to complete full rehabilitation within an efficient deadline. The property reached compliance and the City’s costs and fees were fully reimbursed.
Now, the property has two apartments with a common pool area and equipment, restrooms, and carport structures that are suitable to live in. Congratulations to the City for its continuing efforts to address the safety risks of this property to benefit its residents.
