
Civica Law Wins Lawsuit Between Illegal Cement Business and City of Chino

An illegal cement business in the City of Chino is no stranger to code violations and aggressive tactics against the City to avoid compliance. The Court of Appeal throwing out this business’s lawsuit against the City for its enforcement efforts (First Choice Ready Mix v. City of Chino) is Civica Law’s second time protecting the City from their misdoings, with Partner Valerie Escalante Troesh at the helm.
This time, the business sued the City claiming they were discriminated against since the City advised them that their unpermitted cement business was not a legal land use, where they already set up shop without required approvals, and subsequent code enforcement efforts when they would not comply.
Although the City held meetings to explain the applicable land laws and utilized lawful enforcement tools like issuing citations and filing a nuisance abatement action (which the City succeeded in), the business claimed these actions were unconstitutional. The Trial Court threw out this case in the City’s favor after generously giving this Business 3 tries to state their constitutional claims, which they failed to do.
